Solarized ("we", "us", "our") operates solarized.com.au (the "Site") and is committed to protecting your privacy. This policy explains what personal information we collect, how we use and disclose it, and the rights you have in relation to it.

This policy is written to align with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).

1. What we collect

We may collect:

• Contact details- name, email, phone number, billing and shipping address

• Order and transaction information- items purchased, order history, returns/exchanges

• Payment information- handled directly by our payment processor (we do not store full card details ourselves)

• Account information- if you create an account: username, order history, saved preferences

• Communications- anything you send us via email or contact forms

• Technical/device information- IP address, browser type, device type, general location (derived from IP), collected automatically via the Site and cookies

• Marketing preferences- your opt-in status for email/SMS marketing

2. How we collect it

• Directly from you (checkout, account creation, contacting us)

• Automatically through your use of the Site (cookies, analytics)

• From service providers who help us run the Site and fulfil orders (see below)

3. Why we collect and use it

• To process and fulfil your orders, including shipping and customs documentation

• To manage returns, exchanges, and customer support requests

• To send order updates and transactional communications

• To send marketing communications, only where you've opted in (see Section 6)

• To improve the Site and understand how customers use it

• To detect and prevent fraud

• To comply with legal obligations (e.g. tax and consumer law record-keeping)

We only use personal information for the purpose it was collected for, or a related purpose you'd reasonably expect, unless you consent otherwise or we're required by law.

4. Who we disclose it to

We disclose personal information to the following categories of third parties, only as needed to run the business:

• Shopify- our e-commerce platform host, which processes order and customer data on our behalf

• Payment processors (e.g. Shopify Payments)- to process payments securely

• Klaviyo- our email/SMS marketing platform, for customers who've opted in

• Shipping carriers (Australia Post and any partner carriers)- to deliver your order and provide tracking

• Professional advisers (accountant, legal)- where necessary for business operations

• Law enforcement or regulators, where required by law

We do not sell personal information to third parties.

5. Overseas disclosure

Some of the third parties above (notably Shopify and Klaviyo) may store or process personal information on servers located outside Australia, including in the United States. By using the Site, you consent to this overseas handling of your personal information for the purposes described in this policy.

If you're located in the European Union or United Kingdom, we and our service providers rely on recognised transfer safeguards (such as Standard Contractual Clauses) where your data is transferred outside the EU/UK.

6. Marketing communications

We will only send you marketing emails or SMS if you've opted in (e.g. at checkout or via a signup form), in accordance with the Spam Act 2003 and Do Not Call Register Act 2006. You can opt out at any time via the unsubscribe link in any marketing email, replying "STOP" to SMS, or by contacting us directly. Opting out of marketing doesn't affect transactional messages (e.g. order confirmations, shipping updates).

7. Cookies

The Site uses cookies (via Shopify and analytics tools) to remember your cart, understand site usage, and support marketing. You can control or disable cookies through your browser settings, though some parts of the Site may not function properly without them.

8. Data security and retention

We take reasonable steps to protect personal information from misuse, loss, and unauthorised access, including relying on the security measures built into Shopify's platform. No online system is completely secure, and we can't guarantee absolute security.

We retain personal information only as long as necessary for the purposes described in this policy, or as required by law (e.g. tax and business record-keeping obligations).

9. Access and correction

Under APP 12 and APP 13, you have the right to request access to, and correction of, the personal information we hold about you. To make a request, contact us using the details in Section 12- we'll respond within a reasonable timeframe and won't charge you for making the request.

10. Children

The Site is not directed at children, and we don't knowingly collect personal information from anyone under the age of majority in their jurisdiction without appropriate consent.

11. Data breaches

If we become aware of a data breach likely to result in serious harm, we'll notify affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches (NDB) scheme.

12. Complaints

If you have concerns about how we've handled your personal information, contact us first at info@solarized.com.au so we can try to resolve it directly. If you're not satisfied with our response, you can lodge a complaint with the OAIC at oaic.gov.au.

13. Changes to this policy

We may update this policy from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site after changes are posted means you accept the updated policy.
